Under ORS 426.130, when the evidence is legally insufficient that a person is a danger to himself, he may not be committed as a person with mental illness.

M.S.P. sought reversal of a judgment of commitment under ORS 426.130 because the record did not establish he was a danger to himself because of a mental disorder. The State conceded the evidence was legally insufficient. Reversed.
