Juvenile court had the authority to either amend or dismiss youth’s delinquency petition.

Youth appealed the juvenile court’s refusal to consider a motion to amend or dismiss a delinquency petition. The State conceded that the juvenile court committed error by concluding that it lacked authority to amend or dismiss the petition. The Court found that the text of ORS 419C.261 gives authority for the juvenile court to either amend or dismiss youth’s delinquency petition. Reversed and remanded for juvenile court to reconsider the merits of youth’s petition.
