An extension to the deadline for submitting a petition for review requires the written consent of all parties.

The petition for review in this appeal was due not later than July 13, 2017. The petition for review has not been filed, nor has an extension of time to file the petition for review been granted.

Under OAR 661-010-0067(2), LUBA may only grant an extension if all parties consent in writing to the extension. Petitioners moved to extend the time limit for filing petition for review, but intervenor-respondents did not consent to the extension. Accordingly, on July 14, 2017, LUBA denied petitioners’ motion for an extension. Because a petition for review was not filed within the time required by LUBA rules, and petitioner did not obtain written consent from all parties to extend the time for filing petition for review, ORS 197.830(11) and OAR 661-010-0030(1) require LUBA to dismiss the appeal. DISMISSED.
