Punishes by maximum imprisonment of _ years, $___ fine, or both. A BILL FOR AN ACT Relating to partial birth abortion. Be It Enacted by the People of the State of Oregon: SECTION 1. { + (1) Except as permitted under subsection (2) of this section, a person commits the crime of performing an unlawful partial birth abortion if the person partially vaginally delivers a living fetus and intentionally causes the death of the fetus before completing the delivery. (2) Nothing in this section prohibits a partial birth abortion that is necessary to save the life of a mother if: (a) The mother's life is endangered by a physical disorder, illness or injury, including but not limited to a life endangering condition caused by or arising from pregnancy; and (b) No other medical procedure is available to save the life of the mother. (3) As used in this section, 'fetus' means the biological offspring of human parents prior to and during the birth of the offspring. (4) Performing an unlawful partial birth abortion is a Class _ felony. + } ----------
