A BILL FOR AN ACT

Relating to crime of partial birth infanticide. Be It Enacted by the People of the State of Oregon: SECTION 1. { + As used in this section and section 2 of this 1999 Act: (1) 'Process of birth' means the process that: (a) Begins when: (A) The cervix of the mother has dilated; (B) The protective membrane of the mother's amniotic sac has ruptured; and (C) Part of an infant passes beyond the plane of the mother's cervical os. (b) Ends when the infant is fully delivered from the birth canal. (2) 'Partially born infant' means a child in a state of being born and before complete delivery. (3) 'Partial birth infanticide' means the killing of an infant in the process of birth by a person who deliberately and intentionally performs a procedure on the partially born infant that the person knows will terminate the life of the infant and the procedure does terminate the life of the infant. + } SECTION 2. { + (1) Except as provided in subsections (2) and (3) of this section, partial birth infanticide is a Class A felony. (2) This section does not apply if: (a) A physical condition endangers the life of the mother; and (b) No procedure other than intentionally causing the death of an infant in the process of birth will save the life of the mother. (3) Nothing in this section applies to the termination of the life of a fetus prior to the point in time at which the process of birth has begun. + } ----------

(2) This section does not apply if a physical condition endangers the life of the mother and no procedure other than causing the death of the partially born infant will save the life of the mother. (3) Partial birth infanticide is a Class B misdemeanor and grounds for revocation of a license under ORS 677.190 for a maximum of five years. (4) Nothing in this section applies to the termination of the life of a fetus prior to the point in time at which the process of birth has begun. + } ----------
