A BILL FOR AN ACT

Relating to crime of partial birth infanticide. Be It Enacted by the People of the State of Oregon: SECTION 1. { + As used in section 2 of this 2001 Act, 'partial birth abortion' means a procedure that includes: (1) Breech extraction of the body of a living fetus, excepting the head; and (2) Partial evacuation of the intracranial contents of the fetus to effect a vaginal delivery of a dead but otherwise intact fetus. + } SECTION 2. { + (1) Except as provided in subsection (2) of this section, a person commits the crime of partial birth infanticide if the person intentionally performs a partial birth abortion on a viable fetus. (2) This section does not apply if a partial birth abortion procedure is necessary, in appropriate medical judgment, for the preservation of the life or health of the mother. (3) Partial birth infanticide is a Class B misdemeanor and grounds for revocation of a license under ORS 677.190 for a maximum of five years. + } ----------
